SaarthiShiveshAi ("we", "our", "the app") is operated as a Sole Proprietorship based in Pune, Maharashtra, India.

What we collect:

• Account information: email address and password (encrypted)
• Profile data: name, language preference, age verification status
• App content: characters you create, messages, memory items, stories, people you add, reminders
• Voice data: audio recordings for speech-to-text (processed via Deepgram, not stored permanently)
• Usage data: app activity, feature usage (for improving the service)
• Device data: device type, OS version, push notification token

How we use your data:

• To provide the AI companion service and personalise your experience
• To send festival reminders, birthday nudges, and Daily Heartbeat notifications
• To process payments via Razorpay (we do not store card details)
• To improve the app based on usage patterns

Device permissions — what we ask for: We deliberately request the minimum permissions needed. SaarthiShiveshAi requests ONLY: (1) Microphone access — used solely when you choose to speak to your AI companion, and (2) Notifications — for reminders, check-ins, and your Daily Heartbeat greeting. We do NOT request or access your camera, location/GPS, photos & videos (gallery), contacts, music & audio files, phone or call function, call logs, SMS/messages, files & documents, Wi-Fi/network scan, Bluetooth & nearby devices, or the list of other apps installed on your device. We respect your privacy by only asking for what the service genuinely needs.

Privacy Mode: If you enable Privacy Mode (₹99/month add-on), your memory items, stories, chat history, and personal data are stored encrypted on your device only — they are never sent to or stored on our servers. You may back up this data to your own Google Drive or iCloud account.

Third-party services we use:

• Anthropic (Claude AI) — for AI conversation processing
• ElevenLabs — for AI voice generation
• Deepgram — for speech-to-text conversion
• Azure Cognitive Services — for multilingual voice output
• Razorpay — for payment processing
• Supabase — for secure data storage (servers in Singapore)

Your rights (DPDPA 2023):

• Right to access your personal data
• Right to correct inaccurate data
• Right to delete your account and all associated data
• Right to withdraw consent at any time
• Right to data portability

Data retention: We retain your data for as long as your account is active. When you delete your account, all personal data is permanently deleted within 30 days.

Age requirement: SaarthiShiveshAi is strictly for users aged 18 and above. Romantic and adult personality modes are only accessible after explicit 18+ verification.

📋 Terms of Service

By using SaarthiShiveshAi, you agree to these terms. Please read them carefully.

1. Eligibility: You must be 18 years or older to use SaarthiShiveshAi. By creating an account, you confirm that you are at least 18 years of age.

2. AI companion disclaimer: SaarthiShiveshAi is an artificial intelligence product. The characters in the app are AI, not real humans. The app is not a substitute for real human relationships, professional mental health support, or medical advice. If you are experiencing a mental health crisis, please seek professional help.

3. Acceptable use:

• You may not use the app to generate harmful, illegal, or abusive content
• You may not attempt to clone or impersonate real named individuals without consent
• You may not share your account credentials with others
• You may not attempt to reverse-engineer or hack the service

4. Subscriptions and payments:

• Subscriptions are billed monthly or yearly via Razorpay
• 7-day free trial is available to new users (14 days for waitlist members) — no credit card required
• Monthly plans: no refund once the billing period starts
• Yearly plans: 7-day refund window from payment date only
• Prices are in Indian Rupees (INR) and include applicable GST

5. Voice cloning: Voice cloning features must only be used with your own voice. Using this feature to clone another person's voice without their explicit consent is strictly prohibited and may result in immediate account termination.

6. Intellectual property: All content, design, code, and AI models in SaarthiShiveshAi are the property of SaarthiShiveshAi (Sole Proprietorship). User-generated content (stories, memories) remains your property.

7. Account termination: We reserve the right to terminate accounts that violate these terms. You may delete your account at any time from the Profile settings.

8. Governing law: These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Pune, Maharashtra, India.

9. Changes to terms: We may update these terms. We will notify you of significant changes through the app. Continued use after notification constitutes acceptance.

💳 Refund & Cancellation Policy

This Refund & Cancellation Policy explains how subscriptions, cancellations, and refunds work for SaarthiShiveshAi. By subscribing, you agree to these terms.

1. Free Trial: All new users receive a 7-day free trial (waitlist members receive 14 days) with full Pro access — no credit card required. You will not be charged during the trial. If you do not subscribe to a paid plan after the trial ends, the app will simply stop providing paid features. No charge is made automatically without your explicit payment.

2. Subscription Billing: Paid subscriptions are billed in advance through Razorpay — either monthly or yearly, depending on the plan you choose. Prices are in Indian Rupees (INR) and include applicable GST.

3. Monthly Plans: Monthly subscriptions are non-refundable once the billing period has started. You may cancel anytime, and your access will continue until the end of the current paid month. After that, you will not be charged again.

4. Yearly Plans: Yearly subscriptions include a 7-day refund window from the date of payment. If you request a refund within 7 days of your yearly payment, you will receive a full refund. After 7 days, yearly plans are non-refundable, but you may cancel to prevent renewal for the following year.

5. Add-ons (Privacy Mode): The Privacy Mode add-on follows the same refund terms as your base subscription plan.

6. How to Cancel: You can cancel your subscription anytime from the Profile → Subscription section inside the app, or by emailing us at support@saarthishiveshai.com. Cancellation stops future billing — it does not provide a refund for the current period unless you are within the yearly refund window.

7. How to Request a Refund: To request a refund (for eligible yearly plans within 7 days), email support@saarthishiveshai.com with your registered email address and payment details. We process eligible refunds within 7–10 business days to your original payment method.

8. Exceptions: Refunds are not provided for: partial use of a subscription period, change of mind after the refund window, or violation of our Terms of Service resulting in account termination.

9. Failed Payments: If a subscription renewal payment fails, your paid features will pause until payment is completed. Your data and memories are retained and restored once payment succeeds.
